Employers and employees are dealing with new updates to the U.S. tax code in 2025. Many of these updates focus on fringe benefits, which are those valuable, non-wage perks that often can go overlooked but carry significant financial and tax advantages. Under the new laws, the definition and treatment of qualified fringe benefits have changed to better reflect the modern workplace, especially in areas like remote work, commuting, and wellness.
Understanding Qualified Fringe Benefits
Qualified fringe benefits are benefits provided by an employer that are excluded from the employee’s taxable income, meaning they are not subject to federal income tax. These benefits can range from health insurance and life insurance to less obvious ones like tuition assistance or employee discounts.
To qualify, these benefits must meet specific criteria set by the IRS. Employers will deduct the cost of providing these benefits; meanwhile, employees can enjoy them tax-free. This makes them a win-win when structured correctly.
What’s New in 2025?
Educational Assistance
The 2025 updates reflect changes in how people work and live. One of the biggest updates in 2025 is in regard to educational assistance programs. The new bill makes permanent the $5,250.00 reimbursement per employee for student loans and tuition expenses. The reimbursement was set to expire after 2025. This already applies to tuition, fees, books, and supplies, but now includes expenses related to career credentialing programs and online certifications. These are options that are increasingly relevant in today’s digital economy.
Commuter Benefits
Commuter benefits also saw meaningful adjustments. Employers can now provide up to $325 per month in transportation-related support. This covers not just parking and transit passes but also rideshare services and bike commuting costs. For bike commuters, there was a suspension of qualified tax-free benefits, and in May of 2025, it was voted to be a permanent elimination.
Remote Work
In a major shift, the IRS now treats remote work stipends as qualified working condition fringe benefits. In order to qualify, the expenses must be necessary for the employees’ duties, and they must maintain the proper documentation. These stipends can be used to cover home office expenses such as internet, equipment, or furniture.
Dependent Care Assistance
Dependent care benefits remain capped at $5,000 annually for the tax year 2025. Starting in tax year 2026, the new dependent care benefit increases to $7,500.00. This change will give more flexibility to families while dealing with unpredictable childcare schedules or expenses.
Wellness Programs and Mental Health Support
Mental health and wellness programs have also become covered more broadly. Under the 2025 update, wellness and mental health programs that are employer-sponsored will receive enhanced tax-favored treatment. This includes in-person or digital services and preventive screenings, and wellness events. Therefore, they are not counted as taxable income and can be included in broader employee support strategies without triggering tax concerns.
What Remains Taxable?
Despite these new updates, some fringe benefits will remain taxable. For example, gym memberships will still be taxable unless they are part of a broader wellness plan compliant with the IRS. Likewise, unless tied directly to job responsibilities, housing allowances and employer-paid personal travel are generally taxable. And while gift cards and cash rewards are still popular perks, they will remain taxable under the new rules.
Implications for Employers
Employers looking to optimize their benefits strategy in light of the new laws should:
- Review and update fringe benefit policies
- Educate HR and payroll teams on the tax implications
- Use accountable plans for reimbursements to maintain compliance
- Maintain thorough records for all provided benefits
Final Thoughts
The 2025 tax law updates reflect a broader recognition of today’s workforce realities. The definition of qualified fringe benefits, from hybrid work to education, is expanding to benefit both employers and employees. By staying informed and adjusting their benefit strategies accordingly, businesses can continue to offer attractive compensation packages while remaining in full tax compliance.
